What Is a K-1 Visa?

A K-1 visa is a specific nonimmigrant visa that allows the foreign-born fiancé(e) of a U.S. citizen to enter the United States. Who Is the K-1 Visa For?

  1. One partner must be a U.S. citizen. Lawful permanent residents may not file a K-1 petition.
  2. You both intend to marry within 90 days of the fiancé(e)’s entry. The marriage must be genuine, not solely for immigration purposes.
  3. You are both legally free to marry. Any prior marriages must have been legally terminated by divorce, death, or annulment.
  4. You have met in person at least once within the past two years. USCIS may only waive this requirement in limited circumstances, such as extreme hardship or strict cultural customs that would prohibit an in-person meeting.

What Documents Are Needed for a Fiancé Visa?

The process to obtain a fiancé visa starts with filing Form I-129F, Petition for Alien Fiancé(e), with USCIS. Along with this form, you will generally need to submit evidence that includes the following:

  • Valid U.S. passport or other proof of petitioner’s citizenship
  • Proof of any prior marriage terminations (divorce decrees, death certificates)
  • Evidence of your relationship:
    • Photos together (with context like dates, events pictured, etc.)
    • Communication records (emails, messages, call logs)
    • Evidence of prior in-person meeting(s) (travel receipts, hotel records, itineraries)
    • Statements from people who know you as a couple
