The process begins when the U.S. citizen files Form I-130, Petition for Alien Relative, on behalf of their family member. After the I-130 petition is approved, the path to obtaining a green card depends on whether your relative is inside or outside the United States.
If your immediate relative is already in the United States through a lawful entry (such as with a work or student visa), they may be eligible to apply for a green card without leaving the country. This process is called “Adjustment of Status.”
A key advantage for immediate relatives is the ability to file Form I-485, the green card application, at the same time as the Form I-130 petition. This “concurrent filing” can streamline the process significantly.
If your relative is living outside the United States, they will go through “consular processing.” After USCIS approves the I-130 petition, the case is transferred to the Department of State’s National Visa Center (NVC).
